By using the Site you agree to these Terms of Use. If you don't agree, please don't use the Site. We may update these terms from time to time. The current version is always posted here with its effective date.
You may use the Site for lawful purposes only. Don't attempt to disrupt the Site, scrape it in a way that burdens our servers, misrepresent who you are when you submit a form, or use the Site to send spam or malicious code. We may block access to anyone who misuses the Site.
Unless otherwise noted, the text, design, logos, and other original content on the Site are owned by Make First and protected by copyright and trademark law. You may link to the Site and quote brief excerpts with attribution, but you may not republish substantial portions without permission.
Make First Academy is free to read on this Site and is provided "as is," for general education about building and selling a real product. It is not personalized advice, and it does not guarantee any result.
Academy lessons embed curated videos from other creators. Those videos, and any trademarks, names, or likenesses in them, belong to their respective creators. Embedding a video does not mean the creator endorses Make First, and we remove an embed on a creator's request.
Our open-source platform tools, published under The Fractary, are released on GitHub under their own licenses. Those licenses, not these terms, govern your use of that code.
Enrollment in the guided program described on this Site as "Make First Studio," including tuition, the payment schedule, and the guarantee, is governed by a separate enrollment agreement signed by a parent or guardian, not by these Terms of Use. Where anything on this Site about the program or the guarantee conflicts with the enrollment agreement, the enrollment agreement governs. The guarantee page on this Site is a plain-language summary, not the full terms.
The Site links to third-party sites and services, including embedded videos, the websites of related Fractary products, and the form service we may use for applications. We don't control those sites and aren't responsible for their content, availability, security, or privacy practices.
The Site and everything on it, including the Academy, are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. Nothing on the Site is a guarantee of income, sales, or any other outcome for your teen's business.
To the fullest extent permitted by law, Make First and its members, managers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising out of or related to your use of the Site or anything linked from it, even if we've been advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
We may change or discontinue any part of the Site at any time without notice. We may revise these terms by posting a new version here. Continued use of the Site after a change means you accept the revised terms.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute relating to these terms or the Site will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
